Terms & Conditions

By purchasing a ticket, registering for, or attending an event, workshop, or retreat with sunshinehearted.com ("we", "us"), you agree to the following terms and conditions:

1. Voluntary Participation & Personal Choice

Your safety, comfort, and well-being are paramount, but you are in complete control of your experience. All activities during our events are strictly voluntary. You are fully empowered to opt out, step back, or modify your participation in any activity or session at any point without judgment or explanation.

2. Code of Conduct & Refusal of Entry

​We aim to create a safe, respectful, and supportive space. We reserve the right to refuse entry or ask any participant to leave an event immediately without a refund if their behaviour is disruptive, unsafe, aggressive, or inappropriate toward facilitators or other guests.

​We reserve the right to refuse participation in an activity where we reasonably believe a participant is affected by alcohol, drugs or another substance to an extent that may create a safety risk to themselves or others.

3. Assumption of Risk

You acknowledge that participating in our events may involve physical movement, group interaction, or mindfulness practices. You choose to participate at your own risk and accept full personal responsibility for monitoring and respecting your physical, mental, and emotional limits.

4. Not Medical Advice

All content, activities, guidance, and information provided during our events or published on sunshinehearted.com are for general informational, educational, and wellbeing purposes only. Nothing provided constitutes medical, psychological, or professional healthcare advice, diagnosis, or treatment. Always consult a qualified medical professional regarding any health concerns.

5. Health, Safety & Accessibility

You are responsible for considering whether an activity is appropriate for you and for participating within your own capabilities. If you have a medical condition, injury, are pregnant, take medication that may affect your participation, or have any other concern about whether an activity is suitable for you, we recommend seeking advice from an appropriately qualified healthcare professional before participating.

Please let us know before the event about any accessibility requirements or other adjustments that may assist you to participate safely and comfortably. You are not required to disclose a diagnosis or other medical information unless you choose to do so.

6. Personal Belongings

You are solely responsible for your personal belongings during our events. sunshinehearted.com accepts no responsibility for lost, stolen, or damaged personal items.

7. Dietary Requirements & Food Allergies (For Retreats & Catered Events)

We will take reasonable steps to accommodate dietary requirements notified to us within the specified timeframe but cannot guarantee that food or preparation areas will be completely free from particular allergens, including where catering is provided by third parties.

Please notify us of allergies and dietary requirements at least 14 days before a catered event. If you have a severe allergy, please contact us before booking so that we can discuss whether your requirements can reasonably be accommodated.

Participants with known severe allergies should carry any medication prescribed to them and take their usual precautions.

8. Payment Terms & Ticket Transfers

All event and retreat fees are quoted in Australian Dollars (AUD). Full payment (or an agreed deposit for retreats) is required at the time of booking to secure your registration.

 

Retreat Balances: Remaining balances for retreats must be paid in full at least 30 days prior to the start date. Failure to pay by the due date may result in cancellation of your booking.

​Tickets may only be transferred in accordance with the cancellation and transfer provisions below. Please notify us in writing of any proposed transfer. Tickets may not be resold for more than their original purchase price.

9. Cancellation & Refund Policy

  • Standard Events & Workshops (Excluding Retreats):

    • 7+ days' notice: Full refund provided.

    • 3 to 6 days' notice: Non-refundable, but your ticket can be transferred to a future event of equal value.

    • Less than 3 days' (72 hours) notice: Non-refundable and non-transferable to a later date due to venue and catering commitments (but can be transferred to another person if requested in writing 6+hours prior to the event).

  • Retreats:

    • 30+ days' notice: Full refund provided.

    • 14 to 29 days' notice: 50% refund provided.

    • Less than 14 days' notice: Non-refundable due to upfront venue and supplier costs.

This cancellation policy applies to cancellations or changes of mind initiated by you. Nothing in this policy limits any rights or remedies you may have under the Australian Consumer Law, including where services are not provided with due care and skill, are not fit for an agreed purpose, or otherwise fail to comply with applicable consumer guarantees.

10. Event Cancellation by Us (Force Majeure & Unexpected Events)

We may make reasonable changes to event schedules, facilitators, venues or activities where necessary.

If we cancel an event, you will be offered a full refund of the amount paid or, at your choice, a credit or transfer to another Sunshine Hearted event.

If we materially reschedule or relocate an event and you are unable or unwilling to attend the revised event, we will provide a refund or other remedy where required by the Australian Consumer Law.

To the extent permitted by law, we are not responsible for additional expenses you incur in connection with attending an event, such as travel or accommodation costs, except where such loss is recoverable under the Australian Consumer Law or other applicable law.

11. Respecting Participant Privacy

Some events may involve personal reflection or voluntary sharing. Participants are expected to respect the privacy of others and not disclose another participant's personal stories, experiences or identifying information outside the event without their permission.

While we ask all participants to respect this expectation, we cannot guarantee that other participants will maintain confidentiality.

Age Requirements

Unless an event is expressly advertised as suitable for children or young people, participants must be 18 years or older. Where participants under 18 are permitted, additional consent and supervision requirements may apply.

12. Photography & Media Consent

We take minimal photos and videos during our events to preserve an intimate, peaceful experience (generally if they are taken it would be post event). However, by attending, you agree that photos or video recordings may occasionally be taken and used by sunshinehearted.com for promotional purposes (including our website and social media).

If you do not wish to be photographed, simply inform us or the event facilitator prior to the start of the event, and we will ensure you are excluded from all media.

Please also respect the privacy of other participants and do not photograph, film or record other attendees without their permission.

13. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the maximum extent permitted by law, Sunshine Hearted is not responsible for loss, injury or damage arising from risks inherent in activities voluntarily undertaken by a participant, or from a participant's failure to follow reasonable instructions, disclose relevant safety information, or participate within their own capabilities.

Where our liability may lawfully be limited, it is limited to the extent permitted by applicable law.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising will be subject to the exclusive jurisdiction of the courts of Queensland.
